e-Disclosure Conferences 2008-2009
E-Disclosure conferences are an extremely
good way of getting a leg-up on a subject which sits at the cross-roads of
two technical subjects - the court rules and practice on the one hand, and
the technology available to deal with disclosure proportionately on the
other. Recession amplifies
the need not merely for efficient reaction to new cases but also for
pro-active advice to clients to help them be ready for an increased
expectation of litigation. In
Digicel (St Lucia) v Cable & Wireless we have a new case which shows the
courts' expectations of parties in assessing proportionality. A new
Technology Questionnaire is under discussion. Lord Justice Jackson's new
review of litigation costs puts the spotlight on the expense of
litigation. Hyperlinks are to the
